Gouri Satya reports in today’s Business Standard that the arrest of Ganapati Sachchidananada Swamiji for alleged forgery of documents in a land encroachment case, is only the tip of an iceberg of land grabbing at the foothills of Mysore’s most visible landmark:
“Land grab or allotment of lands in violation of laws and regulations has been rampant at the foot of Mysore’s famous Chamundi Hills.
“The Chamundi foothill was a forest area with dense greenery made of shrubs and trees, amidst cemeteries. People were afraid to go there late in the evenings or in the early hours of the mornings.
“It presents a sad picture today. The fragile eco-system has been irreversibly damaged over the last few years with large-scale encroachments. The hillface has been denuded. They are encroached with layouts and houses, majority of which are illegal.
“Tourist resorts and religious institutions have sprung up with the acquiesance of politicians and officials, including at the top levels. Buildings have cropped up leagally or illegally in this green belt area, which was once set apart for the Nehru Loka project, now abandoned.”

The author has given facts which are already known to the readers of this blog and there was nothing new. I was expecting to read the latest development on the reasons for the High Court stay.
I am still unable to figure out how the judicial system can prevent the police department from conducting a study into the facts. Does this imply that any person can go to the court and get a stay order from the court that no one should look into his wrong doings?
I would have expected that our media and specially our litigant lawysrs would take this cause irrespective of the people involved. Unfortunately we did not have such luck.

Problem with people like Bhamy is that they are so self righteous . In this case he does not even know the reasons for the stay. If people like Sanjay Datt and Salman Khan can get stay even after getting convicted by lower courts, then you need to understand, how the legal system works. No one can be condemned as guilty unless evidence is loaded against him. A stay is only a temporary reprieve for the aggrieved till the prosecution is able to cogently marshal it’s evidence. So have patience and wait !

Stay order in Sanjay Datt or Salman Khan is different. It was not to prevent from looking into the case. In this case it was actually to gather evidences by competent authorities to examine if there is even a case against the swamiji. Thus it could have actually helped the swamiji if there is not a strong case.
For example if some one files a theft case against A and is able to produce some evidence, police will be forced to book a case. It does not mean A is guilty. His opponent would have manufactured the evidence or it could be genuine also. Higher police authorities feel one should start gather more evidence. Under these circumstances is there a role for the judiciary? Is any one’s fundamental or any right being violated?

It is appalling to note that you are prejudiced by one account of statement by a person of dubious nature. First you should find out, whether any forgery had actually taken place. What is the meaning of forgery?? Is it not to impersonate another person?
Self Appointed Guardians of Truth!
Please find the answers for the following questions>
1. Interchange of survey numbers could have been a mere typographical error. For this, we fail to fathom what made the officials to frame cases under Forgery and Cheating sections!
2. Reportedly the document was registered way back in 1979. What made people realise the mistake suddenly, so as to pursue a case on a day of Election Counting with alacricity >> And especially the urgency of the bureaucracy to call an aged person to Police Station amidst a pre-scheduled public program??
3. What was the interest of the District Administration to dig up an alleged malafide act, at the behest of another Bar & Restaurant owner, who is believed to have paid hefty sums, to get his illegal construction (which was sanctioned for a nature cure hospital by the govt. to overcome the land ceiling act) regularised just a week before this incident???
4. It seems that half baked truth finding, myopic view or glycoma (of hearsay and hidden intention) is affecting (blinding) the self appointed guardians of public morality in viewing the entire saga. If not, did some one bother to check, the true antecedents of the complainant and history of the ongoing civil dispute in Mysore courts for the past 10 years??
5. If Dr.Anil Kumar had a genuine grievance or an accusation about the 4 Guntas or 7 ft. x 255 ft, he will try with his steely resolve to get relief from the judicial authorities. Can we be not patient to get the verdict from the courts, before jumping to our our own misguided conclusions after going thru biased/ & often one sided reports of the scribes?
6. How could the same set of officials turn a Nelson’s eye towards the alleged violation of the allotment letter given to Dr. SR Anil Kumar to run nature cure hospital by running a bar and restaurant at the same site??
7. Could some one bother check the columns of news paper, that then commissioner had initiated an enquiry and found out that the entire resort is illegal and should be razed to ground?? (And the preceding Corporation commissioner has initiated another enquiry to hear the same matter on a complaint of local citizens (who were peeved that a bar & Restaurant was running in the vicinity of a school) in January??
8.Can we be oblivious to the fact that before the enquiry report was to be submitted, the official was deputed for training in Assam (probably to avoid the report or to make it redundant)?? And Regularisation process completed with great ugency before the new Govt. took over?
9. Would it not be in the interest of natural justice to advise Mr.Shenoy and other to check facts, before commenting with pre-conceived notions on sub-judice matters?? It is not primary duty of top officials of the district to ensure the process of law and order during the counting on an important day such as 25th may 2008?? How could the resolution/ enquiry of a trivial typographical error aged 30 years; could occupy the first slot in their list of misplaced priorities, so as to enact a drama on a Sunday?? What intention determined the urgency in dealing with a 30 year old error with such great speed and dedication, where as entire colonies are springing up in no time in the lands alloted to scheduled castes in the same vicinity?
There are many more number of unanswered questions, which the guardians of Truth should try to find out>>
A) In this purported/ Alleged act of interchange of survey numbers; what was the actual damage done to the Public??
B) Was there a loss to the exchequer??
C) How was the complainant affected by this Gift to a charitable Trust, in which public are the beneficiaries?? (It is an important fact that no trustee of a public should benefit from the activities of the trust> It seems that the same principle is followed in this instance too)
D) Could Dr. SR Anil Kumar expect any relief??
E) What was the immediate or long term negative impact on the local citizens who were immensely benefited daily thru the charitable services rendered by the SGS Charitable Hospital>
After visiting the facts, Primarily it seems that this is a tussle between a Charitable Hospital and an Bar & Restaurant>
It also appears prima facie that representatives of Swamiji are silent so as to respect the time-tested convention of not speaking on subjudice matter.
Let us hope for happy and amicable solution of this trivial issue (of 4,000 sft strip of land) quickly, so as to avoid wastage of resources in terms of time for readers, valuable time of courts, media airtime, news print, business of hotelier, more importantly attention of Charitable Trusts, who are a ray of hope for the society in these ages of selfishness and greed.
Truth alone triuphs! Let us hope & Pray for that!

My own experience from the past 30 years is Sri Swamiji takes our karmas and relieves from the pain and suffering and he bares that pain.
WHY SRI SWAMIJI DO THIS
Swamiji takes our Karmas and he suffers on behalf us and creates faith on God and Dharma.
Swamiji also had been doing many charities for the poor, to name few schools for destitute children, home of destitute and aged female, Medical services for Poor and people living in remote places, propagate Vedic culture, self help equipment for the handicapped, shelter and support for uncountable human beings.
Sri Swamiji’s mission is to propagate and create faith on dharma and God. He has been striving tirelessly from the past 5 decades to achieve his mission. The rowdy and muscle men will always target the sober, soft and kind people. During Sri pada vallabha swami, Sri Shirdi sai baba avatara the selfish people troubled like this.
Dr. Anil kumar is a doctor how ever running a Bar & Restaurant, he carries dirty credentials. If Dr.Anil Kumar is a wise person he will not fight with a charitable organization. If he is greedy he can ask a price based on the market rate. Arun kumar approach seems different, he is trying to black mail the ashrama . He is applying pressure tactics with his political and muscle powers to grab the Hospital premises.
It is shame why the Government, especially Police is supporting a businessman than a charity house serving the poor and needy.

FOLLOWING ARE THE POINTS TO PONDER:-
1. THERE IS NO DOUBT THAT THE INTERCHANGE OF PATTA NOS. MIGHT HAVE OCCURRED DURING THE RESURVEY DONE ABOUT A DECADE AGO AND THAT TOO, INADVERTENTLY. THERE IS NO QUESTION OF ANY MALA FIDE INTENTION ON THE PART OF SGS ASHRAM TO GET IT CHANGED IN COLLUSION WITH THE MUNICIPAL CORPORATION OFFICIALS AS IS ALLEGED IN THE MEDIA REPORTS.
2. HOW A CIVIL CASE HAS BEEN BLOWN OUT OF PROPORTION AND THE DY. COMMISSIONER AND THE COMMISSIONER OF POLICE RECOMMENDING COD PROBE INTO THE WHOLE EPISODE HAS NOT BEEN MADE PUBLIC. THE REASONS ARE ONLY KNOWN TO THE OFFICIALS CONCERNED.
3. THE CHARITABLE AND PUBLIC ACTIVITIES AT THE ASHRAM PRECINCTS ARE WELL KNOWN NOT ONLY TO THE LOCALS BUT ALSO TO THE PEOPLE AROUND THE GLOBE.
4. HOW DR. ANIL KUMAR, A DOCTOR BY PROFESSION, HAS BEEN ALLOTTED THE LAND IN THE PRIME LOCATION TO RUN BAR AND RESTAURANT IN VIOLATION OF THE NORMAL BYE-LAWS AND REGULATIONS?
5. WHY ALL OF A SUDDEN, THIS ISSUE IS BEING HIGHLIGHTED IN THE MEDIA AS AN UNPARDONABLE CRIME AND WHY GOOGLE HAS BEEN ENGAGING IN SUCH MUD SLINGING WITHOUT PROPER VERIFICATION OF THE FACTS AND VERACITY OF THE TITLE DEED?
6. HOW THE BUREAUCRATS HAVE BEEN FEEDING THE LATETST UPDATES TO THE HINDU AND OTHER NEWSPAPERS SO AS TO MALIGN THE NAME OF A SWAMIJI ENGAGED IN DOING THE PUBLIC GOOD. IS IT THE WAY WE SHOULD BEHAVE WHEN A PHILANTHROPIC INSTITUTION IS DOING ITS JOB IN ITS RIGHT EARNEST.
7. WILL THE SAME YARDSTICK BE ADOPTED IN THE CASE OF OTHER THAN HINDU RELIGIOUS INSTITUTIONS WHICH ARE NOT EASILY VULNERABLE TO SUCH MALAFIDE ATTACKS.
8. HARKING BACK TO THE POLEMICAL ISSUE, WHY IN A SUDDEN HURRY, THE LAND ALLOTTED TO DR. ANIL KUMAR WAS REGULARISED AGAINST ALL ODDS AND INFRACTIONS.
9. WHETHER THERE HAS BEEN A NEXUS BETWEEN THE POWERS THAT BE AND DR. ANIL KUMAR HAS TO BE CLEARLY BROUGHT OUT BY THE MEDIA RATHER THAN INDULGING IN MUDSLINGING IN A LOPSIDED MANNER.
10. EVEN HYPOTHETICALLY ASSUMING FOR ARGUMENT’S SAKE THAT THERE HAS BEEN A BLUNDER OF INTERCHANGE OF PATTA NUMBERS, WHY NO ACTION WAS TAKEN FOR A PRETTY CONSIDERABLE PERIOD AND WHAT PROMPTED THE CIVIC OFFICIALS TO WAKE UP FROM DEEP SLUMBER AND INITIATE ACTION AT THE TIME OF COUNTING OF VOTES AND ELECTIONEERING WAS GEARING UP.
